Welcome to NewReality.me, the online presence of New Reality, LLC (“NewReality”, “we”, “us” or “our”) respects your privacy. When we refer to “Users”, we mean our Customers who use our Services, including Visitors to our sites. References to “Customers” means those who have chosen to create an account on the Website and/or use our Services. “Visitors” are those who visit the site but do not engage with our content or use our Services. “Services” are all programming, events, resources, and content provided on or via the NewReality.me Website.

Web Site Host is the third-party vendor that supports and maintains the NewReality.me web site. “Payment Processor” refers to the third-party vendors who collect payments and process credit cards on behalf or New Reality, LLC.

“Personal Information” is anything that can identify you individually, either directly or when combined with other data. Directly identifying date is your name, e-mail, addresses, localization, IP-addresses, photos, and account information. Data on your behavior as a User of our site is also personal. The cookies that we place, and analytics tools native to our website can track browsing activities such as what content you scroll past and what you choose to click on.

We’re providing this document so that you know what Personal Information we collect, what we do with it, and your choices and rights.

Acceptance of Terms

By visiting our Website or using any of New Reality, LLC’s Services, you are agreeing to the terms of this Privacy Policy which governs your use of the Website. By providing us information offline, you are also agreeing to the terms of this Privacy Policy.

The New Reality Website is hosted by our third-party Web Site Host, Squarespace. This document describes how New Reality, LLC handles your information. Through the Squarespace platform, our third-party Payment Processor is Stripe, see the Stripe Privacy Policy at https://stripe.com/privacy.

We also make PayPal available as an option. Customers choosing their PayPal account for payments, please refer to PayPals’s Privacy Policies.

New Reality, LLC does share data with GOOGLE analytics. The nature of that process is described in the sections below.

Information Collected

In the course of operating the Website and/or interacting with you, we will collect the following types of information.

We will retain Personal Information, that which can identify individuals, either directly or when combined with other data such as your name, e-mail, addresses, IP-addresses, photos, bios provided to us, and account information.

If you’ve granted permission through your device settings, we may collect your location information. We use your location information to display accurate date and time information.

We also receive, through Squarespace, information about User interactions with our site, but in an anonymous, aggregated or pseudonymized form which does not focus on you individually. We use this data to evaluate, provide, protect or improve our Services (including by developing new products and services). We will retain and evaluate aggregated information on all recent visits to our website and how Visitors move around different sections of our website for analytics purposes to understand how people use our website so that we can make it more intuitive. PERSONAL INFORMATION

Personal Information is anything that can identify you individually, either directly or when combined with other data. Directly identifying date is your name, e-mail, addresses, localization, IP-addresses, photos, and account information. Data on your behavior as a User of our site is also personal. The cookies that we place, and analytics tools native to our website can track browsing activities such as what content you scroll past and what you choose to click on.

When you respond to a survey, register for a class, or purchase any product or service, you may be required to establish a New Reality, LLC account through which we retain Personal Information about you, such as your name, address, email address, and phone number. In addition, some Customers will be asked to provide us with photos, biographies, and video which will also be retained.

We will collect the use information about the New Reality, LLC services you have previously purchased or attended to make suggestions to you for other content and events in which we believe you will also be interested

The emails, other communications, and documents that you send us or otherwise contribute, such as customer support inquiries or posts to our Customer message boards or forums are also collected while using the Website.

Please be aware that information you contribute on public parts of our site is available to others.

ORDER AND BILLING INFORMATION

When you place an Order for Paid Services directly with us, we obtain limited information about your payment card from our Payment Processor, such as the last four digits, the country of issuance and the expiration date. Currently, the only Payment Processor with whom we share data is Stripe. Payments you make using PayPal are transacted via your own PayPal account. Stripe uses and processes your complete payment information in accordance with the Stripe Privacy Policy.

New Reality, LLC will retain only record of items purchased and the payment amount received for each. Payment Information collected and processed by our third-party payment vendors, pursuant to the terms and conditions of their privacy policies and terms of use.

OTHER INFORMATION

In addition to the information noted above, we may collect additional information (collectively, the “Other Information”). Such Other Information may include:

A. From You. Additional information about yourself that you voluntarily provide to us (e.g., via a survey), product and service preferences, and other information that does not identify you personally.

B. From Your Activity. We retain aggregated, rather than individually identifiable, information about how Visitors use the Website, including, without limitation:

  • IP addresses, which may consist of a static or dynamic IP address and will sometimes point to a specific identifiable computer or device; browser type and language; referring and exit pages and URLs; date and time; amount of time spent on particular pages; what sections of the Website are visited; and similar data; and

  • Information about devices used, including the type of device; universally unique ID; advertising identifier; MAC address; operating system and version (e.g., iOS, Android or Windows); carrier and country location; hardware and processor information (e.g., storage, chip speed, camera resolution, NFC enabled); network type (WiFi, 3G, 4G, 5G, LTE); and similar data.

C. From Cookies Information that we collect using “cookie” technology. Cookies are small packets of data that a website stores on your computer or mobile device’s hard drive so that your computer will remember your visit. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to help us collect Information and to enhance your experience using the Website. If you do not want us to place a cookie on your hard drive, you may be able to turn that feature off on your computer or mobile device. Please consult your Internet browser’s documentation for information on how to do this and how to delete persistent cookies. However, if you decide not to accept cookies from us, the Website may not function properly.

D. Third-Party Analytics - We work with third parties that collect data about your use of the Site and other websites or online services over time for non-advertising purposes. This aggregated information is provided to us by Google Analytics and our Web Site Hosting service company to improve the performance of the services and inform our decisions in programming, delivery of services, and for marketing purposes. This Privacy Policy does not cover the privacy practices of our third-party partners. To learn more about the practices of these companies, please read their privacy policies. 

By accessing and using the Website, you consent to the processing of data about you in the manner and for the purposes set out in this Privacy Policy. Please be advised that if you opt out of any service, you may not be able to use the full functionality of the Website.

From Other Sources, we also may collect or receive information from third parties, such as Facebook and/or other social media sites. To learn more about the practices of these companies, please read their privacy policies. 

Accessing and Modifying Personal Information and Communication Preferences

If you have registered for the Website, you may access, review, and make changes to your Personal Information, Billing Information, and certain Other Information by following the instructions found on the Website. In addition, you may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any New Reality marketing email or sending a request to info@NewReality.me. Customers cannot opt out of receiving transactional emails related to their account or their Orders. We will use commercially reasonable efforts to process such requests in a timely manner.

How We Use and Share the Information

New Reality, LLC has a legitimate interest in using your Personal Information. Specifically, we have a legitimate interest in the following:

  • To operate the New Reality, LLC platform and provide you with tailored advertising and communications to develop and promote offerings to our Users.

  • To analyze and improve the safety and security of our Services - we do this as it is necessary to pursue our legitimate interests in ensuring that the Website is secure, such as by implementing and enhancing security measures and protections and protecting against fraud, spam and abuse.

  • To provide and improve the Services, including any personalized services - we do this as it is necessary to pursue our legitimate interests of providing an innovative and tailored offering to our Users on a sustained basis.

  • We employ other companies and individuals to perform functions on our behalf to provide technical assistance, Web Site Hosting, order fulfillment, payment processing, and marketing analysis. These other companies will have access to the Information only as necessary to perform their functions and to the extent permitted by law.

  • To the extent permitted by law, we may also disclose the Information: (i) when required by law, court order, or other government or law enforcement authority or regulatory agency; or (ii) whenever we believe that disclosing such Information is necessary or advisable, for example, to protect the rights, property, or safety of New Reality, LLC or others.

Information You Share

Please keep in mind that whenever you voluntarily make your Personal Information – for example on message boards or web logs; via social media sites; through email; during webinars, classes, group coaching sessions, telephone conferences; or in comment or chat areas – that information can be seen, collected, heard, and/or used by others besides us. We cannot be responsible for any unauthorized third-party use of such information.

How we retain your personal information

We retain Personal Information regarding you or your use of the Services for as long as your Account is active or for as long as needed to provide you with the Services. We also retain Personal Information for as long as necessary to achieve the purposes described in this Privacy Policy, for example, to comply with our legal obligations, to protect us in the event of disputes and to enforce our agreements and to protect our and others’ interests.

The precise periods for which we keep your Personal Information will vary depending on the nature of the information and why we need it. Factors we consider in determining these periods include the minimum required retention period prescribed by law or recommended as best practice, the period during which a claim can be made with respect to an agreement or other matter, whether the Personal Information has been aggregated or pseudonymized, and other relevant criteria. For example, the period we keep your email address is connected to how long your Account is active, while the period for which we keep a support message is based on how long has passed since the last submission in the thread.

As Users may leave or come back to us after an Account becomes inactive, we don’t immediately delete your Personal Information when your trial expires or you cancel all Paid Services. Instead, we keep your Personal Information for a reasonable period of time, so it will be there for you if you come back.

Your Access to the Data

Where applicable law requires (and subject to any relevant exceptions under law), you may have the right to access, update, change or delete Personal Information. Please note that, for technical reasons, there is likely to be a delay in deleting your Personal Information from our systems when you ask us to delete it. We also will retain Personal Information in order to comply with the law, protect our and others’ rights, resolve disputes or enforce our legal terms or policies, to the extent permitted under applicable law.

In cooperation with our third-party partners, primarily our Website host, Squarespace, we rely upon a number of means to transfer Personal Information which is subject to the European General Data Protection Regulation (“GDPR”).  These include:

Standard data protection clauses -- We will transfer, in accordance with Article 46 of the GDPR, Personal Information to recipients that have entered into the European Commission approved contract for the transfer of personal data outside the European Economic Area.  

Other means -- We may, in accordance with Articles 45 and 46 of the GDPR, transfer Personal Information to recipients that are in a country the European Commission or a European data protection supervisory authority has confirmed, by decision, offers an adequate level of data protection, pursuant to an approved certification mechanism or code of conduct, together with binding, enforceable commitments from the recipient to apply the appropriate safeguards, including as regards data subjects’ rights, or to processors which have committed to comply with binding corporate rules.

In accord with applicable laws and at your request, New Reality, LLC will delete the Personal Information it holds about you (unless we need to retain it for the purposes set out in this Privacy Policy).

Please note that in the course of providing the Services, we collect and maintain aggregated, anonymized or de-personalized information which we may retain indefinitely.

How We Protect the Information

New Reality, LLC takes commercially reasonable steps to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction.

Additionally, our Website host, Squarespace has declared that --

While no service is completely secure, we (Squarespace) have a security team dedicated to keeping Personal Information safe. We maintain administrative, technical and physical safeguards that are intended to appropriately protect against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse and any other unlawful form of processing, of the Personal Information in our possession. We employ security measures such as using firewalls to protect against intruders, building redundancies throughout our network (so that if one server goes down, another can cover for it) and testing for and protecting against network vulnerabilities.

We cannot guarantee that the Information that you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mail sent to or from the Website may not be secure, and you should therefore take special care in deciding what information you send to us via email.

Children

We do not knowingly collect Personal Information from children under the age of 13 through the Website. If you are under 13, please do not give us any Personal Information. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children to never provide Personal Information through the Website without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Information to us, please contact us, and we will endeavor to delete that information from our databases.

IMPORTANT NOTICE TO NON-U.S. RESIDENTS

It is important to note that the Website and their servers are operated in the United States. If you are located outside of the United States, please be aware that any Information you provide to us will be transferred to the United States. By using the Website and by providing us Information when using our services, you hereby irrevocably consent to this transfer and our use of the Information and data provided by you in accordance with this Privacy Policy.

Our business Customers who are California residents have certain rights under the California Consumer Privacy Act (“CCPA”) with respect to the Personal Information that we collect about you:

We reserve the right to modify this Privacy Policy at any time, in which case we will post the changes to this Privacy Policy page. When we change this Privacy Policy, we will update the effective date at the top of this Privacy Policy. By accessing the Website and/or using our services after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the Information.
